MESOZOIC DAWN
Game License and Services Agreement
Revised 6 June 2026 Mesozoic Dawn Game License and Services Agreement for users outside Mainland China, covering official-server wipes, paid entitlements, community-server compliance rules, and registration-region-based HKIAC arbitration while the Simplified Chinese version prevails in case of conflict.
Agreement update notice: To better support the game's global operations and further regulate the online community environment, technical security, and the protection of players' core digital assets, we have comprehensively revised this Agreement. This update particularly strengthens Chapter 5 on game-service licensing and official-server data rules, including the added Test Server wipe disclaimer; Chapter 7 on intellectual property, anti-decompilation, reverse engineering, and UGC skin rules; Chapter 8 on in-game purchases and virtual-goods trading restrictions; Chapter 10 on player-hosted dedicated servers and local Host operations, including rules on unlawful server naming, unlawful announcements, malicious third-party traffic diversion, illicit sales, fraud, exit scams, the official absolute disclaimer, and one-click Token revocation; and Chapter 13 on governing law, language conflicts, and arbitration, including a registration-country/region-based arbitration split, under which users registered in CN are subject to arbitration before the Hangzhou Arbitration Commission in Hangzhou, while users registered outside CN are subject to arbitration before HKIAC in Hong Kong. Switching the in-game display language does not affect that determination. Please read this Agreement carefully.

1. Introduction
This Game License and Services Agreement (the Agreement) is entered into between you and NEXTINDIE Studio (we, us, or our) and constitutes a legally binding contract. Please read each provision carefully and make sure you understand it fully, especially provisions that exempt or limit our liability, restrict user rights, or govern dispute resolution and jurisdiction.
Please read all provisions of this Agreement carefully. If you agree to this Agreement, you may continue to use the MESOZOIC DAWN game services. If you have any questions, complaints, or suggestions regarding this Agreement or the game services, please contact us at team@nextindie.cn.
If you are a minor in your country of residence or jurisdiction, for example under 18 years of age, please review this Agreement together with your legal guardian and obtain the guardianâs express consent before using the game services.
2. Definitions
Agreement: This Agreement, the Privacy Policy, and any revisions we may publish from time to time. Once officially released, those materials form an inseparable part of this Agreement. Capitalized terms not defined in this Agreement have the meanings given in the Privacy Policy.
Game Rules: The user rules, player policies, announcements, reminders, and notices relating to MESOZOIC DAWN that NEXTINDIE Studio may publish or amend from time to time.
MESOZOIC DAWN Game: The game âMesozoic Dawnâ operated by NEXTINDIE Studio, including without limitation PC, mobile, and any other versions or forms of the game, together with related software, server-side programs, local Host components, and supporting documentation.
Game Services: The online operations, lobby verification, global server-list matching, and technical support services we provide in connection with the game.
You: Also referred to as the player or user, meaning a natural person authorized to use the game and its services. If you apply to operate a community dedicated server or enable local multiplayer hosting, you may also be referred to in this Agreement as an Operator or Host Player.
Game Data: Any data generated during your use of the game and recorded by the servers, including without limitation character data, creature data, virtual item data, behavior logs, and network communication snapshots.
3. Game Account
Account Registration and Identity Compliance
To access and use the game services, you must have a game account. You may register with your own email address or sign in through third-party platforms such as Google, Apple, Steam, or Epic Games Store.
You agree to complete any identity verification or real-name registration required by the laws and regulations of your jurisdiction, and to provide truthful, lawful, and accurate information. You must not impersonate any other person.
Account Security
You are responsible for maintaining the security and confidentiality of your account. All activities conducted through your account are deemed to be your own actions, and you bear full responsibility for them.
If you become aware of any unauthorized use of your account or any security vulnerability, you must notify us immediately.
Account Use Restrictions
Ownership of game accounts remains with NEXTINDIE Studio. You receive only a limited right to use the account under this Agreement. You may not provide the account to any other person in any manner, including by transfer, lease, lending, or commercial sale.
Account Deletion
You may request deletion of your game account in accordance with the official instructions we provide. After deletion, all game data, characters, virtual items, and value-added services associated with that account will be permanently erased in accordance with applicable law and cannot be restored.
4. Global Data Collection, Use, and Privacy Protection
Protecting usersâ personal information and privacy is one of our basic principles. In accordance with the Privacy Policy, we collect the information you actively provide and the information generated through your use of the services in order to deliver the services, optimize network performance, and protect account security.
Global Privacy Compliance Statement
- Users in the European Economic Area (EEA): We process personal data in compliance with the General Data Protection Regulation (GDPR). You have the right to access, correct, and delete your personal data, and to restrict or object to processing.
- California users: We comply with the California Consumer Privacy Act (CCPA) and do not transfer or sell usersâ personal privacy data.
- Childrenâs privacy (COPPA): We do not knowingly collect or solicit personal information from children as defined by applicable local law. If a guardian discovers that a child has provided personal information to us without consent, please contact us promptly so we can delete it.
5. Service License and Official Server Data Rules
Provided that you comply with this Agreement and applicable law, we grant you a personal, worldwide, non-transferable, non-sublicensable, non-exclusive, limited legal license to use MESOZOIC DAWN and its related services on supported devices for non-commercial purposes only.
Unless we have given prior written permission, you may not use the game content for any commercial gain, including without limitation unauthorized commercial livestreaming, publishing audio or video recordings, or organizing commercial esports events.
Changes to Dynamic Character and Biological Evolution Data on Official Servers; Abnormal Loss Disclaimer
You acknowledge and agree that real-time game data generated on official public game servers (Official Servers), including without limitation your local character growth state (life stage, growth percentage, evolution values, and similar attributes), egg incubation and nest progress, AI companion relationship chains, AI offspring simulation data, and other dynamic runtime data, does not constitute permanently retained property.
In addition to scheduled or unscheduled wipes performed for major version upgrades, technical iterations, or network maintenance, if network fluctuations, sudden physical server failures, latent client-side or server-side bugs, abnormal physics collisions (such as becoming stuck in terrain or abnormal fall detection), external hacking attacks against a server, or data synchronization failures caused by network latency result on a particular server in abnormal character death, unexpected reset of growth progress, loss of incubating eggs or nest progress, or corruption or disappearance of AI companions or AI offspring data, we have no obligation to restore data, revive any character or creature, compensate egg or nest progress, or provide any financial damages or compensation.
Maintenance Commitment During Normal Technical Upgrades
During routine version updates and system upgrades, we will make commercially reasonable efforts to maintain backward compatibility so that your Official Server character information and gameplay progress can be preserved as much as possible.
However, we do not provide any absolute guarantee of preservation, and we are not liable for any financial compensation arising from the loss of dynamic network data caused by technical upgrades.
Special Wipe and No-Compensation Statement for Test Servers (Test Server / Beta Server)
Any separate official game testing server (Test Server) is a special and inherently unstable environment used by the developer for feature testing, technical iteration, bug fixing, and stress testing. You expressly acknowledge and agree that the underlying infrastructure and dynamic character data on a Test Server are naturally subject to a high degree of uncontrollable instability.
We may, at any time, for any reason, and without conditions, delete, reset, or wipe all or part of the character data, dinosaur creatures, and gameplay progress on a Test Server as development and iteration needs require. Such wipes may occur without prior notice or explanation, and we owe no duty of notice or explanation, nor any form of virtual-asset restitution, core-entitlement restoration, financial damages, or compensation in connection with any Test Server reset or wipe.
6. General User Conduct
You understand and agree that you are fully responsible for all conduct under your game account, including any statements you publish in the game, any content you upload, and all resulting consequences.
When using the game or the game services, you must comply with the laws and regulations applicable in your location, and you may not use the game or services for any unlawful or prohibited activity, including without limitation:
- spreading rumors or promoting terrorism or extremism;
- infringing the lawful rights and interests of minors;
- distributing obscene, pornographic, or gambling-related content;
- promoting hate speech or engaging in any form of racial, gender-based, or religious discrimination.
Measures for Violations
If a user violates the conduct standards in this Agreement, we may, depending on the severity of the circumstances and under this Agreement and the Game Rules, independently take one or more actions and may disclose the result of the enforcement action. Such measures may include warnings, muting, content reset, reduction or restriction of in-game gains, deletion of character data, temporary or permanent account bans, and refusal to provide services.
Labeling of AI-Generated Content
To comply with laws and regulations applicable to deep synthesis and generative AI services, if the game includes AI-related functions, we will add clear labels in the relevant interaction scenes. Generated text or images will be marked as âAI Generatedâ where appropriate.
7. Intellectual Property; Anti-Decompilation, Reverse Engineering, and UGC Skin Rules
All ownership rights and intellectual property rights in MESOZOIC DAWN and all of its contents, including without limitation code, images, audio, art assets, dinosaur and creature models, dynamic libraries, server-side programs, client executables, network communication protocols, gameplay systems, and text, belong to NEXTINDIE Studio.
Strictly Prohibited Technical Conduct
Unless expressly permitted by law or authorized by us in writing, you must not engage in, and must prevent others from engaging in, any of the following:
- reverse engineering, disassembling, decompiling, or otherwise attempting to extract, discover, or interpret the source code or underlying algorithms of the game software, client, officially released dedicated server program, or local Host components;
- intercepting, copying, modifying, hooking, injecting, cracking, or creating derivative works based on data released into device memory or system communication data necessary for operation of the software;
- modifying, forging, or tampering with runtime instructions or core network verification code, or interfering with the normal operation of the game services through unauthorized third-party software, plug-ins, cheats, synchronization tools, or peripheral systems;
- separating any part of the game, such as code segments, 3D models, or audio assets, for use in other commercial or non-commercial projects, or distributing modified versions of the game through any unauthorized platform.
Definition of UGC Skins and Technical Prerequisites
For purposes of this Agreement, User-Generated Content (UGC) skins means in-game creature or dinosaur skins, textures, materials, and related derivative artwork designed, created, and uploaded by players using MESOZOIC DAWN development tools, art assets, creature models, external 3D software, or officially authorized third-party workshop channels such as Steam Workshop, communities, or other designated submission channels.
UGC Intellectual Property Ownership and Global License
- Derivative-work ownership limitation: You acknowledge and agree that because UGC skins include or materially depend on the original creature models, proprietary art assets, and underlying code of MESOZOIC DAWN, such UGC skins are legally considered derivative works of the game. Any intellectual property embedded from the original game remains the property of NEXTINDIE Studio.
- Perpetual, cross-platform, royalty-free license: When you publicly publish, upload, display, or allow others to download a UGC skin through the game, an official workshop, or any related community, you automatically, unconditionally, and irrevocably grant NEXTINDIE Studio a worldwide, perpetual, free, non-exclusive, and fully sublicensable legal license.
- Scope of official use rights: We may, without notice to you and without paying any fee, royalty, or revenue share, freely use, copy, modify, adapt, publish, translate, distribute, communicate online, package into builds, optimize technically, promote commercially, and make your UGC skin available to players across the global verification network.
Creatorâs Absolute Compliance Commitments
Any player who creates and uploads a UGC skin must make the following legally binding commitments:
- Originality: The uploaded skin content must be independently created by the uploader, or the uploader must have obtained lawful, complete, and sublicensable written authorization from the original rightsholder.
- No third-party infringement: You may not copy, imitate, or appropriate copyrighted assets, registered trademarks, trade dress, or patents from any third-party game, film, television work, animation, real-world brand, or protected artist.
- No unlawful or offensive content: Skins may not contain obscene, pornographic, politically sensitive, religiously discriminatory, extremist, bloody or violent content, or content that insults others or infringes privacy or reputation rights.
Official Platform Disclaimer and Infringement Takedown Measures
- Neutral storage and no substantive review duty: NEXTINDIE Studio only provides neutral technical storage, lobby distribution, and platform display services for UGC skins uploaded or shared by players. We do not assume any prior, proactive, or substantive obligation to review the vast volume of user-generated content for infringement. Any lawsuit, damages, administrative penalties, attorneysâ fees, or reputational losses arising from a creatorâs infringement of third-party rights are solely the legal responsibility of that creator. If a UGC skin causes loss to NEXTINDIE Studio because it infringes third-party rights, the responsible creator must indemnify us in full.
- Notice and takedown: Once we receive a valid third-party infringement notice, such as a DMCA-compliant complaint, or otherwise verify that a UGC skin is suspected of infringement, we may immediately remove, delist, destroy, or blacklist that skin within the global lobby verification system without prior notice to or consent from the creator. If a skin is taken down for copyright infringement, we will remove ordinary playersâ rights to use that skin and, under Section 8.6 of this Agreement, provide affected ordinary players with equivalent in-game currency restitution. For the original creator who uploaded the infringing skin, we may deduct all in-game proceeds, provide no compensation, and additionally freeze the creatorâs workshop privileges, revoke any self-hosted server Token, or permanently ban the account.
8. In-Game Purchases and Virtual Goods Trading Restrictions
Finality of Purchases
Virtual goods in the game, including without limitation in-game currencies, skins, and value-added items, are electronic virtual value-added services provided by us. Once an in-game purchase is completed, the transaction is final and irreversible. Unless mandatory law in your jurisdiction requires otherwise, purchases are non-refundable. Virtual goods have no cash value and cannot be redeemed for real currency under any circumstance.
Official System Restriction and Elimination of Off-Platform Fiat Trading
The game allows players to trade skins and certain designated virtual items, but all such trading must occur exclusively through the official in-game trading system. Players are strictly prohibited from using real-world currency or any unofficial trading platform outside the game to privately buy or sell in-game characters, dinosaurs, items, or accounts for profit.
If verified, we may immediately ban the involved accounts and remove the related items. We are not responsible for any economic disputes or fraud arising from private off-platform transactions between players.
Permanent Retention of Paid Entitlements and Core Account Rights
Unlike dynamic local data on Official Servers that may be reset due to version refactors, your core account entitlements, including account information, paid or unlocked premium characters such as specific creature expansion packs, purchased items, purchased virtual currency, and permanent skin assets, are treated as permanently retained core rights.
These paid assets and core entitlements will not be wiped when Official Servers undergo major upgrades, incompatible data resets, or server wipes.
Isolation of Sensitive Data and Storage Architecture
To protect usersâ assets and privacy on a global basis, we use a data-isolation architecture. Sensitive and core asset data, including account information, ownership of paid characters, paid items, and virtual currency, is securely stored in an independent global control gateway and within the account systems of third-party distribution platforms such as Steam, Apple App Store, Google Play, and Epic Games Store. The individual game servers do not store and may not modify this sensitive data.
When an Official Server is wiped or reset in any manner, you only need to log back into your account to re-activate all paid characters and item entitlements that you have already purchased in the new server environment.
Abnormal Refunds, Malicious Chargebacks, and Account Restrictions
- Definition of unofficial channels and malicious refunds: You acknowledge and agree that all top-ups and in-game purchases must be completed through official channels or authorized third-party platforms. Any attempt to exploit platform vulnerabilities, use unauthorized top-up agents, or obtain virtual goods and then, without proper justification, initiate an abnormal refund request, chargeback, or transaction reversal through a card issuer or payment platform such as Apple App Store, Google Play, or Steam is treated as fraudulent conduct and a serious breach of this Agreement.
- Multi-level technical enforcement measures: If our control system detects malicious refunds or fraudulent chargeback records on your account, we may, without prior notice, apply one or more of the following restrictions or penalties: deduct the virtual currency, skins, character data, or other game assets associated with the refunded transaction; if those assets have already been consumed, set the relevant virtual-currency balance to a negative value; automatically lock top-up functions and prohibit store purchases until the balance becomes positive again or the violation is corrected; and, for serious, high-value, or repeated malicious refund cases, impose a permanent account ban across all platforms while also blacklisting the corresponding hardware identifiers (HWID) and IP addresses to prevent future registration or access.
- Legal recourse: We provide no compensation for account bans caused by malicious refunds. We also reserve the right to recover from the violating user any processing fees, penalties, or legal costs resulting from malicious refund conduct.
Reworks, Delisting, and Compensation for UGC Skins
- Nature of the usage license: Skins, virtual props, and other in-game items in MESOZOIC DAWN, including UGC skin assets contributed by players or the community, are part of the gameâs overall electronic record. By purchasing, redeeming, or unboxing such assets, you receive only a limited, non-exclusive, revocable right to use that asset during operation of the game, and not any ownership right or intellectual property right in the asset itself.
- Disclaimer for reworks and delisting: To maintain overall technical compatibility, visual-art iteration, balance adjustments, network optimization, or to comply with expired license cooperation, applicable law, or regulatory policy, we may rework any UGC skin or virtual item in the game, modify its appearance, adjust its attributes, or permanently remove it from the in-game store or the global verification network.
- Equivalent in-game currency restitution: If a skin is materially reworked or permanently delisted for reasons attributable to us, we will not refund real-world currency under any circumstance. Instead, we commit to providing a transparent community compensation plan. Where technically feasible, when a relevant skin is fully removed, deleted, or materially changed, the system will automatically credit the affected player with an amount of in-game virtual currency equal to the amount actually spent to obtain or unlock that skin. The player may use that returned in-game currency to exchange for other skins, items, or functions of equal value in the store. This in-game currency restitution constitutes our full contractual and technical compensation, and the player may not use such delisting or rework as grounds to pursue any refund action, arbitration, or claim against us or any third-party distribution platform.
9. Rewarded Advertising Policy
MESOZOIC DAWN may provide optional rewarded advertising. After voluntarily viewing an advertisement, players may receive specific in-game items or rewards. Viewing rewarded advertisements is entirely optional and will not affect the completeness of the normal gameplay experience or the core game functions.
Limitation of Responsibility
The advertisements shown in the game are provided by third-party advertising service providers such as Yandex and ironSource LevelPlay. We will make reasonable efforts to ensure that the ads are appropriate for the game audience, but we do not guarantee the absolute accuracy of third-party advertising content or the products and services promoted through those advertisements.
10. Player-Hosted Dedicated Servers and Local Host Rules
To protect the gameplay experience of MESOZOIC DAWN players across distributed communities worldwide, the game permits player-operated multiplayer servers. However, the behind-the-scenes server operators (Operators) and players who enable a local host session (Host Players) must strictly comply with the following multilayered regulatory, red-line, and absolute-disclaimer framework:
Categories Within Scope
- Category A: Dedicated community servers (Token-authorized). These are dedicated servers deployed by Operators on independent physical servers or cloud servers and opened to the public. They are publicly listed in the in-game global community server list.
- Category B: Local self-hosted sessions (Host / LAN mode). These are local lobbies created through the built-in Host function of the game client. Even if this mode is only shown in the LAN server list, if you make it available to other players through any physical or virtual LAN tool, including VPNs, peer-to-peer gaming tools, or multiplayer platform clients, you will be treated as an Operator under this Agreement and must fully comply with all anti-cheat and anti-commercialization rules in this section.
IP and Token Binding for Dedicated Community Servers
- Email application procedure: Any user who wishes to host and operate a Category A dedicated community server must submit a server-hosting application to the official email address team@nextindie.cn and clearly state the unique fixed public IP address intended for that server.
- Low-level enforcement: After approval, we will issue a unique authorization Token for that server. The Token is logically and technically bound in our control database to the server IP address provided by the Operator. If the actual running IP of the server does not match the IP bound to the Token during the game lobby handshake, validation will be blocked automatically and the server will not appear in the in-game server list.
- Security and confidentiality: The authorization Token is an important credential for the Operatorâs independent operation and may not be transferred, rented out, or disclosed to any third party in any form. The applicant bears full responsibility for any violation resulting from poor Token or IP configuration management.
- Conduct constitutes consent: Sending a server-hosting application email, providing an IP address, or clicking the in-client option to enable a Host session or LAN multiplayer constitutes your digital signature and full acceptance of this chapter and all other terms of this Agreement.
Absolute Anti-Commercialization Red Lines and Illicit Monetization Boundaries
Whether you operate a Category A dedicated community server or a Category B local host session, your operations must remain strictly non-profit in nature. Operators and Host Players are strictly prohibited from engaging in any of the following commercial or profit-seeking violations that materially affect game balance or endanger community safety:
- Basic rule: only gratuitous donations are allowed: Operators may accept only voluntary, gratuitous donations made by players purely out of support for the game community, with no quid pro quo of any kind. Such donations may be used only to offset direct physical hosting costs such as server hardware rental, network bandwidth, and DDoS protection.
- No sale of balance-affecting virtual property: You may not directly, indirectly, or in disguised form sell for value any in-game virtual characters, dinosaur or creature data, character levels, attribute bonuses, weapons, equipment, building materials, in-game currency, or any other virtual item with in-game functionality or balance impact.
- No sale of privileges or privilege-for-payment exchanges: You may not directly or indirectly sell special server-management privileges such as Admin or OP permissions or any special console-command rights. You may not, under labels such as âsponsorship lottery,â âdonation bonus,â âpaid custom character or creature,â âpaid server access threshold,â or âpaid group-entry fee,â use in-game virtual items, specific character data, or any game or group-management privilege as consideration in exchange for sponsorship or payment.
- No gambling mechanics: You may not establish loot boxes, lotteries, roulette systems, or any other gambling-like recharge-reward mechanism related to in-game virtual assets within a community server or its affiliated social groups.
Server Naming, Announcement Content Compliance, and Red Lines Against Malicious Third-Party Traffic Diversion
All Operators of dedicated community servers (Category A) and all Host Players of local self-hosted sessions (Category B) must also unconditionally comply with the following content-compliance red lines when configuring and operating their servers:
- No unlawful, non-compliant, or sensitive content: Operators may not configure, publish, or disseminate in any Server Name, server-lobby description, in-game scrolling announcement, message of the day (MOTD), or any external community associated with the official verification network, such as notification groups, Discord channels, QQ groups, or similar communities, any text, symbols, sensitive keywords, or external links that violate applicable local laws and regulations, contain pornographic or vulgar material, involve politically sensitive material, religious discrimination, hate speech, or otherwise infringe the lawful rights and interests of any third party.
- No malicious third-party traffic diversion or non-compliant promotion: The community-server list is a neutral technical indexing service provided by us and may not be used as any unauthorized commercial-profit or external-traffic diversion tool. You may not use server names or announcement systems to publish any unauthorized commercial advertising, game top-up services, or grey-market information. You are strictly prohibited from carrying out any form of traffic-diversion conduct that directs users to other game products, commercially promotes external competing products, redirects users to unauthorized platforms, maliciously siphons off the official player community, or otherwise harms the overall operating interests of MESOZOIC DAWN.
- Immediate delisting and Token revocation for violations: For any community server that engages in the above non-compliant naming or traffic-diversion conduct, we may, without any prior notice and without any explanation, directly revoke and invalidate that server's authorization Token remotely through the global lobby system. The bound public IP address of that server may be permanently placed on an official blacklist, and the server may immediately and permanently lose its display and hosting privileges in the global community-server list.
Tiered Penalties, One-Click Revocation of Authorization, and Technical Sanctions for Hacking or Fraud
If we verify through periodic spot checks, technical audits, or player reports that you have violated any technical, content-compliance, or anti-commercialization red line in this chapter, we may impose the following tiered enforcement measures depending on the severity of the circumstances:
- Handling of serious violations (immediate revocation and permanent delisting): For community servers that engage in the traffic-diversion conduct or unlawful naming described in Section 10.4, or that privately sell in-game virtual property, sell Admin privileges, or otherwise disrupt game balance and operating order, we may directly and remotely invalidate the authorization Token without prior notice.
- Hacking attacks and serious fraud (cross-platform permanent enforcement): If an Operator maliciously tampers with the program during server operation, carries out hacking attacks, or engages in serious fraud such as large-amount scams, exit scams, or false top-up schemes that materially endanger player property, we may impose the highest-level penalty: a global and permanent account ban across all platforms on that Operator's or Host Player's official personal game account, a full freeze of that person's digital assets, and global blacklisting of the related hardware identifiers (HWID) and IP addresses, thereby permanently depriving that person of the right to register new accounts and access the game services in the future.
- Official assistance with rights protection and reports of suspected crimes: Where an Operator is suspected of serious fraud, illegal fund-raising, online scams, or other conduct violating applicable law, we may, after receiving reports from affected players, proactively assist those players in filing complaints with relevant third-party payment platforms and, where judicial or public-security authorities intervene, lawfully cooperate by providing the necessary underlying technical data, including real-name registration information and IP network logs, to assist in formal investigations.
Official Absolute Disclaimer and Neutral Isolation for Community Servers
- Network and operational independence: All dedicated community servers (Category A) and self-hosted local or virtual LAN sessions (Category B) created, hosted, or operated by players or third parties are independent distributed network nodes separate from us. We provide technical maintenance and content support only for Official Servers that are personally deployed and routinely maintained by us.
- Complete disclaimer for service shutdowns and wiped data: If a community server is forcibly delisted, restricted from display, or has its Token revoked because the Operator violated this Agreement, or if that community server goes offline, loses data, wipes local character data, or ceases operation because of the Operator's own technical error, hardware failure, voluntary shutdown, or exit scam, all resulting economic losses and data responsibility are borne solely by that community-server Operator. We bear no duty to notify any ordinary player, recover data, or provide any financial compensation for the shutdown or wipe of any community server.
- Complete isolation of player purchases and economic conduct: Any player's purchase, sponsorship, or exchange for any services within a community-server environment or its associated social groups is a voluntary civil act solely between that player and the relevant community-server Operator. Any sponsorship loss, loss of so-called top-up assets due to server closure, illegal-trading fraud, or other economic dispute arising from such conduct is unrelated to us, and we bear no joint liability, advance-payment obligation, intermediary guarantee, or incidental compensation obligation of any kind. The appearance of a community server in the lobby list is merely a neutral technical data-indexing service and does not constitute endorsement, approval, or joint guarantee of any kind.
11. Service Availability and Global Disclaimer
NEXTINDIE Studio strives to provide stable, secure, and reliable game services. However, to the fullest extent permitted by law, we make no express or implied warranty that:
- the game services will be uninterrupted, timely, free from security vulnerabilities, or free from programming errors;
- the game will satisfy all of your subjective expectations regarding mechanics or balance;
- all in-game server-list functions will remain fully available at all times.
Limitation of Liability
We are not liable for any interruption, rollback, loss of data, or economic loss caused by global backbone network failures, force majeure, device incompatibility, hacking attacks, or system updates.
We specifically state that, because this game belongs to the pure biological-simulation and survival-evolution genre, its underlying systems involve highly complex life-state determination, large-scale real-time interaction across AI companion and offspring behavior trees, and high-frequency physics-collision calculations. We do not make any commercial or technical guarantee that the game will be absolutely error-free with respect to program defects, bugs, abnormal damage or death calculations, or delayed data synchronization that may arise during operation. Any reset of character growth progress, abnormal creature death, destruction of eggs or nests, or breakage of AI companion or offspring relationship chains caused by such technical defects constitutes an inherent operational risk of this game's genre and simulation-survival mechanics, and we are not liable for any direct, indirect, incidental, joint, or punitive damages arising from such localized technical losses on a single server.
We are also not liable for the content stability, data compliance, information security, player speech compliance, losses caused by Token delisting or revocation due to unlawful naming or traffic diversion, or any economic dispute arising from a player's purchase of services within any third-party or player-operated community server, including all dedicated community servers and Host virtual-LAN sessions in mainland China and overseas, whether the claimed damages are direct, indirect, incidental, joint, or punitive.
12. Service Changes, Restrictions, and Termination
NEXTINDIE Studio reserves the right, as necessary, to modify, update, or terminate part or all of the game content and core functionality at any time based on the development of the global live-service ecosystem and changes in applicable law.
If a user violates any core term of this Agreement, especially red lines involving decompilation, hacking attacks, cheat creation, malicious refunds or chargebacks, private cash trading, illegal commercialization of community servers, unlawful or non-compliant community-server naming or traffic-diversion content, or serious community-server fraud, we may immediately terminate the limited service license granted under this Agreement, stop providing game services to that user, recover and revoke any authorization Token, and do so without any obligation to compensate.
13. Governing Law, Language Conflicts, and Arbitration
Language Versions and Prevailing Interpretation
This Agreement is prepared and published in Simplified Chinese and other language versions. If any ambiguity, conflict, or inconsistency exists among language versions, the Simplified Chinese version shall be the final and authoritative text and shall prevail in interpretation.
Governing Law
- Users whose registered country or region is Mainland China: The formation, validity, interpretation, performance, and resolution of disputes under this Agreement shall be governed by the laws of Mainland China, excluding its conflict-of-law rules.
- Users whose registered country or region is outside Mainland China: The formation, validity, interpretation, performance, and resolution of disputes under this Agreement shall be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, excluding its conflict-of-law rules.
Dispute Resolution and Arbitration
Any dispute, controversy, claim, or demand arising out of or in connection with this Agreement, including any issue regarding its formation, existence, validity, interpretation, breach, or termination, shall first be resolved through friendly consultation. If the dispute is not resolved within thirty (30) days after it arises, the dispute shall be handled according to the country or region corresponding to the system language obtained by the program at registration as follows:
- Users whose registered country or region is Mainland China: Either party shall submit the dispute exclusively to the Hangzhou Arbitration Commission for final and binding arbitration in Hangzhou, China, in accordance with the arbitration rules in effect when the application for arbitration is filed. The arbitration tribunal shall consist of one (1) arbitrator. The arbitration shall be conducted in Chinese. The arbitral award shall be final and legally binding on both parties.
- Users whose registered country or region is outside Mainland China: Either party shall submit the dispute exclusively to the Hong Kong International Arbitration Centre (HKIAC) for final and binding arbitration in Hong Kong, China, in accordance with the arbitration rules in effect when the application for arbitration is filed. The arbitration tribunal shall consist of one (1) arbitrator. The arbitration shall be conducted in English. The arbitral award shall be final and legally binding on both parties.
Binding Registration Anchor; Language Switching Does Not Affect the Dispute Resolution Path
Your act of switching the interface display language in the game client, for example from Simplified Chinese to English, Traditional Chinese, or another language, or vice versa, is purely a user-experience preference. Under no circumstances does it constitute any change to, denial of, or withdrawal of the country or region information corresponding to the system language obtained by the program at registration, nor does it change or re-determine the dispute resolution path, including the place of arbitration, arbitration institution, governing law, and jurisdiction. Both parties confirm that the country or region information corresponding to the system language obtained by the program when your account was registered is the sole, final, and non-unilaterally changeable basis for determining the dispute resolution path.
14. International Copyright Complaints (DMCA Notice) and Miscellaneous
Copyright Protection and Takedown (DMCA)
We respect and protect intellectual property rights. If you are an overseas copyright owner and believe that any user-generated content (UGC) in the game or content on a community dedicated server infringes your lawful copyright, you may send a written copyright notice to our designated email address in accordance with the requirements of the U.S. Digital Millennium Copyright Act (DMCA), including the infringing link, proof of ownership, and your contact details. After verification, we will promptly remove or disable the allegedly infringing content.
Severability
If any provision of this Agreement is held to be partially or wholly invalid or unenforceable for any reason, that invalid portion shall not affect the legal validity of the remaining provisions, which shall continue in full force and effect and remain binding on both parties.
15. Third-Party Services and License Terms
In providing global network-lobby maintenance, data analytics, and rewarded advertising distribution, MESOZOIC DAWN integrates components and services from the following third-party providers. When you use the corresponding services, you must comply not only with this Agreement but also with the applicable terms and privacy policies of those third parties.
